Missing of rental agreement. Tenant is demanding rs 500000 to vacate s

Dear sir/madam, my father has rented a shop to javed in jan 2018. Now my father expired, on 28th oct 2018. Now I am owner of this property, but rent agreement is missing. Tenant gave rent till March 2019 after which he stopped paying rent. Now he says he had paid rs 5 lakh to my father as a heavy deposit, he is asking to return rs 5 lakh for vacating shop. What action can be taken.

in this matter it's need to file the matter before the civil court as to vacate the shop as per the rent control Act. and it's depends upon where is the shop is situated because each State has it's own rent control Act

sir firstly you will have to find out the original rent agreement.
the terms and conditions of the rent agreement agreed upon are very crucial at this stage because if the tenant is saying he has paid 5 lakh to your father then the same must have been recorded in the original rent agreement..once you obtain a copy of the same and if there is no clause of payment of 5 lakh, then in that case we can issue a legal notice for non payment of dues from the month of April 2019..

He must be having copy... u can lodge a police complaint against hum and call him to show the papers and account statement. Otherwise u will have to file eviction suit against him. You need to show papers. Whether you have applied for succession certificate.
