Matrimonial, FIR (498A), for Quashing

Hello, My wife filled FIR (498A) against me last year. I surrendered my self, went to custody for 1 month and there after I got the bail on the ground of Mutual Contested Divorce within one month. I filled the divorce from my side and now we came to an agreement to do it mutually. My question is, it suggestible to go for Quashing of FIR (498A) as I have all the grounds to make the FIR false. OR I should go with the process that she will come to court and say that the matter is taken care by mean of settlement. Let me know if any further details are required.

Since u have settled the matter it is always better to end it harmonious and get quashing from high court by her statement being recorded in it that is best and faster and cheaper as a contested case will take several dates and may be year or more for quashing

aapane bataya hai aap ke khilaf 498 ki FIR hui thi ab aapka mutual divorce ho chuka hai yadi aap FIR ko Karana Chahte Hain Tu Mujhe FIR ki copy aur order ki copy main aapki FIR High Court se Khwaish Karva dunga

Hi,

When you have arrived at settlement and both the parties have agreed to settle all dispute mutually then my suggestion is that you should file quashing on the basis of settlement/compromise arrived between the parties and the other party will support you in the proceedings.
