Maharashtra bill for legal heir fee for widows

22-Jul-2026 (In Civil Law)
For legal heirship certificate, the Maharashtra bill havcapled the court fee to 10000 for widows. But if the widow is with a minor child and both are legal heirs in certificate, does this capping not apply and they will have to give normal court fee of 75000?

The ₹10,000 cap depends on the specific Maharashtra Court Fees amendment and eligibility. Mere inclusion of a minor heir does not automatically remove the benefit. Verify the applicable provision or consult the local court registry.

The applicant needs to be a widow only then she will be allowed to obtain the hair ship certificate by paying the court fees of Rs 10000 only. Though one of the applicants is minor the same will not make any difference and the court fees will be kept to rupees will be maximum of Rs 10000 only. The Court fees can be paid online and challan needs to be produced in the court records only after payment of fees the heirship certificate will be issued.

If you and ut minor child are applying together, the ₹10,000 court fee benefit may still be available. However, if the court treats the minor child's share separately, additional court fees may be payable. The exact amount depends on the court and the applicable Maharashtra court fee rules. Please get the documents checked by a advocate before filing.
