In such an agreement, there are various factors to be considered. Did you give the loan for the sole purpose of keeping the man out? Are two different circumstances? Anyway, you can opt for civil recovery, where in you can claim the amount with interest as well as performance of agreement.

In this case a simple notice at a bare minimum should do the trick.. it is tricky as any agreement in constraint of marriage is always a subject of question.. However I’ll be ready to take up your matter happily..

Your position is legally robust if the loan arrangement is documented (written agreement, bank transfer, WhatsApp exchanges); the friend's violation of the express covenant—allowing the abusive man back—constitutes material breach of contract, while her pre-planned collusion (if evidenced through communications) elevates this to fraud under IPC §420 and grounds for both civil recovery and criminal complaint. File a Recovery Suit under CPC §9 for the principal amount plus interest at 6% p.a. (or contractual rate if stipulated), and simultaneously issue a legal notice citing the specific breach of the protective covenant; simultaneously lodge an FIR under IPC §420 (cheating) and §406 (criminal breach of trust) to create collateral pressure and evidence of fraudulent intent. The domestic abuse context, while sympathetically framed, must not dilute your legal framing—focus ruthlessly on contract violation and documented collusion. Engage a recovery-focused advocate experienced in loan suits and fraud pleading to structure the civil claim for quick attachment of her assets under the Bharatiya Nagrik Suraksha Sanhita (BNSS) and extract settlement before she dissipates funds or the abuser gains control of marital assets.
