Liquor store operating in residential area on a notified commercial street
03-Jun-2023 (In Civil Law)
A liquor store is operating in our colony. The colony is a residential colony and the building in which the liquor store is operating from is abutting a notified commercial road as per MPD 2021. Despite objections from residents of the colony and the RWA, the liquor store had got the license from Excise Dept. for distributing liquor.
We’ve been told that as per MPD 2021, liquor stores are not allowed under mixed use in residential area, but still the store owner has been granted a license for the same.
Is the store allowed or not as per MPD 2021?
What may be done by residents and the RWA to get it closed and/ or relocated to appropriate area?
Thank you!
You and the residents must act jointly to solve this problem. You can send them a legal notice regarding your grievances. And in that notice you can say that transfer your shop to appropriate location or face legal action. You can also file the same to the higher authorities.
