First take a proof that the persons selling the property are the only legal heirs of so & so. Now a days a family dependent certificate containing the names of the legal heirs are issued by revenue Authorities(in my telangana region). You can also give a publication in news paper circulating in the area where the property and legal heirs reside regarding the intending purchase from the intending sellers.

The Son and daughter needs to approach the court for succcession of the prperty in their name as they are the legal heirs for their parent's. Once the succession is granted by court you can purchase the property.
