31-May-2025 (In Civil Law)
I’m writing to request legal advice regarding a proposed installation of a cell tower near our residential property located at Burari, Delhi. Could you please advice on what steps we can take, what are our rights in this situation ,and whether there are any legal grounds to challenge the project.

Who is proposing it? Usually, it’s a telecom company or a contractor on their behalf. Where is it being placed? On private land (with the owner's consent), or on public land (like municipal property)? How close is it to your property? Distance and visibility often affect your ability to object. Zoning and permits: Check your local zoning ordinances. Some zones allow such installations by right; others require special permits or public hearings.

I understand your concern regarding the installation of the cell phone tower near your residence. Depending on the status of the compliances you can take action against such installations. The best and quickest is sending a legal notice and parallelly seeking a temporary injunction from the concerned civil court. Further steps will be required to be taken to finally get the installation process completely stopped depending upon other facts. Feel free to connect for further help in the matter.

You can challenge the installation of the cell tower under environmental, health, and zoning grounds. File an objection with the Municipal Corporation of Delhi (MCD) citing possible radiation hazards, lack of public consultation, and violation of local building bye-laws. You can also file a writ petition in the Delhi High Court if procedural norms or public interest are compromised. Supporting documents like RTI replies, expert opinions, and public objections will strengthen your case.

You have a right to object to the proposed installation if it affects your health, safety, or enjoyment of property. You may file a written objection with the MCD and the Department of Telecommunications citing public health concerns, lack of NOC from RWAs/residents, or zoning violations. You can also file a writ petition before the Delhi High Court if the installation violates environmental norms, EMF exposure limits, or is being done without due procedure or consent. Collect RTI information, copy of approvals, and raise objections early.
