Legal action against builder who refusing to give possession of flat

My parents book in flat in under construction building .The builder promise that he wil give the possesion in 3years .. in 2010 my parents give the full amount around 38LAKHS..and got the registration in 2011 .. now its almost 7 years .. last year building were complete bt now the builder is not giving the possesion of flat.. builder saying that flat had gone to tenant .. i wil give in sum other building.What step can be taken?

Now a days it is very common , but don't worry solution is very easy. By taking legal recourse you'll get your flat or get your momey along with compensation. Also the builder can sentenced to imprisonment (jail) 1. By filling CONSUMER COMPLAINT before state consumer forum. 2. Simultaneously you can file criminal complaint with RERA. Note: if you go for civil litigation it will take lot of time , and builder will take it granted.

hello you can take a criminal action against him for breach of trust and cheating you can also put money recovery suit, was there agreement or as such receipt of money given by him to your parents, he has deceived your parents.

why builder behave like that.... have agreement of agreement to sale that make u and between builder.... have in agreement the period of flat possession was mentioned??.... if yes..... or agreement register one then u can get benefit of ur right..... u can filed the suit for possession and declaration.... and recovery of money.....
