Jurisdiction of case to get back money sent through net banking

Hello, In January, I had transferred money from my bank ,HDFC Bank in Madhapur, through netbanking to one person. The person had told me that he will send me the money back by May itself , but he kept cancelling and now he is not even receiving my calls. How can I start legal action against the person ? Should I lodge a police complaint against him , or seek help of a lawyer to file a civil case ? The person I transferred the amount to and the bank that I transferred the amount to are in Jhanjharpur ( Bihar ) . In case a police complaint / civil case, where should I register it , in Hyderabad or Jhanjharpur .

A. There are many unanswered questions in your query. Did you execute Pronote? Do you have any evidence that it’s a loan? In the assumption that you don’t have any evidence let me put the response in brief. You can file a suit under the provisions of CPC. Send a legal notice explaining him the consequence. People wish to settle the matter once they receive legal notice from the advocate if not suit is the only option for you. You can try the case in Hyderabad rest depends on the facts of the case.
