Is original copy of buyer-seller agreement necessary to cancel booking
11-Dec-2023 (In Civil Law)
A flat is booked in Agra. Consideration is being paid both by cash & cheque. Now I intend to cancel the flat and wanted to claim the refund from the builder. Now the builder is telling me you have to give application requesting the cancellation of flat & original buyer-seller agreement. Please advise me whether the original buyer-seller agreement is necessary or I can give the photocopy of same.
You can file an application with intent to cancel the booking a long with a copy of agreement and a affidavit in support of your application. But make sure before filing the the application you must read your copy of agreement and take suggestion of an seasoned advocate in order to find out the legal consequences out of legal terminology contained in agreement. May be you incure a cost of 5000 rs for suggestion but that save your 500000 rs invested in agreement and an interest acrued out of that money.
Yes it is necessary, but if you had lost the original or could not present the same you could make an affidavit of that ,With all particulars as mentioned in original, With the Declaration that about list of original.
