Is OC required for projects commencing in 2016

I am planning yo buy a flat 2bhk. The property has no OC, CC or RERA. The builders says that because the construction started on 2016 so, it does not require these documents. Now the project is completed and many flats are already occupied. Could you please clarify if it is ok to purchase this property and what are all the othe necessary documents should i check before purchase?

Dear Sir/Madam, in purchase a property the document verification is very important role to buy the property, property must have title over the property, subsequently approvals and NOCs from concerned authorities is very necessary. If not produces the same by the developer/builder/property owner, that property is not valid in the eye of law and also is not having legally valid marketable title. I am sincere advice you should not buy the said property. All the best.

It is not the case that as it was started in 2016 it does not require RERA , but because it was over 60 percent complete when RERA was notified. Anyway, remaining two OC and CC are required even otherwise, as they were requirements of Rules of Coprporation. so ask him for these two and inform what he says about these. I believe the apartment is in Bangalore.

Yes you must scrutinise every title deeds with the help of your advocate

Hi, though there are many occupants for this property but suggest to choose only such property which has clear titles and approvals from all the authorities as per the law of the land. Without any of the sanctions and valid titles the property can come under the lens of demolition at any time as per the decision of the government or the legal authorities.
