Immediate solution to verbal nuisance by neighbor (Uncle)

12-Jan-2023 (In Civil Law)
Hi, my father allowed my uncle to build house on first floor. Now I want to sell that property. I am ready to give valid compensation for the amount he invested. But he is not willing to move. The legal documents for the property is in my father’s name What would be legal way to address this issue and how much time it will take to resolve the issue legally.

i would assume that this property is your father's self acquired immovable property, In that case he has all the rights to sell the property only to the part of land. However the only issue you face is the investment and expenditure your uncle has done and his rights created when your father agreed to let him build on the premises as he is in legal possession, moreover if he in not willing to leave the premises, the only recourse is to file a suit for eviction and repossession.
