How to resolve issue regarding transfer of property

09-Jun-2023 (In Civil Law)
Dear Sir/Madam, Here Person A sells the property (house) to Person B. Before the transfer of property in Gram Panchayat(Already application filed to transfer the property by Person A after the sale which is the acceptance of the Person A to transfer) to Person B, but before the transfer the property, in few days it made an attachment in the court for the debts made by the Person A. So the property transfer in under pending due to the case filed on it. So to release the property(because Person B in position), Person B have paid the debts of the Person A even after the payment of the property value or its sale price. But, now the Person A have again filed a petition to don't transfer the property to Person B just to cheat Person B. Is the objection kept by the Person A valid as it is in the court order? Person A have literally cheated Person B after the payment of the total property value and also his debts amount. How can this be solved to transfer the property to Person B.

--B had made a mistake. While paying the debt amounts to the debtor of A, B should have taken sworn affidavit of consent and no objection of A for the transfer of property to B (which is already made). Now B has to convince the debtor to withdraw the suit and attachment on the property. Once the attachment is gone, you will get the title.

After that B has to a money recovery suit against A for the money paid to clear the debt of the debtor along with interest and damages. Additionally, B can file cheating case against A for doing cheating with B before the local police station.

Dear Client,
My first question is whether the property was transferred by A to B by a valid Sale Deed. If so, even though A filed an application before the court for not transferring the property, B can file his valid objection that A already transferred the property in his name. A`s objection will be overruled and property will be transferred by order of court, even if A will not cooperate for transfer. Engage competent civil legal expert advocate who deals in civil suits of transfer of property / title suits.
