How to divide the ancestral property among four sisters
30-May-2023 (In Civil Law)
Dear Sir We are four daughters of our mom & dad. My father has not got any right and share in the ancestral property but now he wants share in the ancestral property. But my uncle and aunty, his son & his wife along with my another auncle and aunty doesn't want to give it to us due to which everyday there is chaos in the house. Please guide us what to do.
As per ur case did ur grandfather has made any will of the property before his death. If the Wil of the property has made it clear that ur father has right then u have right to claim it. If ur grandfather has no Will then u have to apply to district court for divide it equally.
Well, you have not mentioned your cast and religion . Actually civil matter varies with its . Inspite of this, you must've to consult your lawyer. There is only remedy for this to file Partition suit
Thanks ,
Thanks ,
Venerated Sir
Your grievances has been apparently elaborated in Indian Succession Act which avers that ancestral property shall be divided amongst all share holders who belongs to the same pedigree. Your family come under same pedigree, ergo as a legal heir you can file partition suit for own right over land. Give me feedback and call me for more information.
