how to claim share in parential property in dispute with brother

We Hv a joint property of four members that is me my brother my sister and mother.but my brother does not want to sell it.as he is enjoying the rent from this property. He is not willing to give us rent nor he wants to sell it.how can.we solve this problem. Should we go to court?how long will it take to settle this dispute in court? Can we claim for rent?

You can file suit for Partition or declaration.and if your area it is not possible to divide the property than court may order to sell the property and money will be divided into 4 members .if any one among you wants to purchase it than he may do this and you get your share as well others also
