How can I apply for a living will/advance Directive in Andhra Pradesh?

In Andhra Pradesh a living will can be executed as per the Supreme Court guidelines . You must draft it in writing , clearly expressing your medical treatment preferences . It should be signed by you in the presence of two Independence witnesses and counter signed by a Judicial Magistrate of first class . The magistrate will keep a copy and forwarded it to the District Court and concerned person for record . It is legally valid and enforceable .

In India, the Supreme Court in Common Cause v. Union of India (2018) recognized the validity of Living Wills/Advance Directives. To make one in Andhra Pradesh, you must execute it in writing, signed by you and attested by two witnesses, preferably in presence of a Judicial Magistrate of First Class (JMFC). The Directive should clearly state your wishes regarding medical treatment in case of terminal illness or permanent vegetative state. The JMFC will countersign and preserve one copy, while copies can be given to your family and treating hospital. Steps in Andhra Pradesh: Draft a written living will / advance directive clearly stating your wishes. It must be signed by you in presence of two witnesses. It has to be countersigned by the Judicial Magistrate of First Class (JMFC) in your area. The Magistrate will keep one copy in his records and also send copies to the District Court Registry and to your family doctor/hospital if you mention.
