How can i file a case in India if iam staying in Dubai

I'm staying in Dubai and want to file a civil case in India against a customer who has not paid full amount for the products i sold to him. Told amount is around 70 lakhs plus i charge interest @ 8-9% because of delay, so total amount around 1 cr+. I have been told a Power of Attorney would be required to be made as i will not be able to come to India for filing the case and appearing in civil court. I want to know: 1. will this Power of Attorney have it to be on a Stamp Paper, if yes, of what value? 2. Will it have to be notarised or attested ?

in order to recover to lacs there are two ways one is to by filing recovery suit and if it's company and there is admitted amount for the payment you may file petition under 272 of companies act. indeed a power of attorney holder may contest the suit on your behalf and you consult the cosulate of the country you are residing in. the POA needs an attestation/apostile

Yes gpa have to be on stamp paper and about value its depend on circle value where property situated and it would be notarised with attested wittness and there should be statement of all witnesses for better record of further view and about filling. Of civil suit you can file with the pleader but at the time of examine of witnesses and other you have to appear before court.etc

There shall be a special power of attorney instead a general power of attorney, .
Kindly Provide the full disclosure of facts, because certain things shall be taken into consideration while filing a civil suit .

You may attorn someone here in India by giving a special power of attorney.He/she will be able to initiate proceedings on your behalf and persue them without you though you may be required to tender your evidence in person i e by presenting yourself in person before the court. The power of attorney has to be attested and on a stamp paper of value as applicable to the place where it is executed.

Yes a suit for damages/recovery can be filed simultaneously a criminal complaint on behalf cheating and fraud played on you can also be reported.Therfore yes we can ask the same amount on basis of interest whatever you feel to go with Simple Interest @ of 18 or 24 .Besides this you heard right for civil matter a SPA can be executed by you in someone's favour to attend proceedings on your behalf and you can mark your presence only on first day of hearing..Thanks
