We where given wrong report of PET scan and we hsve decide to take the matter to the court. nnHow are going to do that? nWhat is needed to form the case? nnWhat are the posidures file the case?

negligence claim requires that the person bringing the claim establish four distinct elements: duty of care, breach, causation, and damages. seeking monetary compensation before the Civil Courts, High Court or the Consumer Dispute Redressal Forum under the Constitutional Law, Law of Torts/Law of Contract and the Consumer Protection Act. b) Punitive action: filing a criminal complaint against the doctor under the Indian Penal Code.

you can file a case .....but before you have to issue notice to where you got the wrong report and if any damages to the pet on the basis of wrong report if yes you will get compensation also and where you got wrong report from hospital or some testing centre?

we need to see if this is a case of medical negligence and take appropriate action. most of these actions happen through consumer court. kindly share the report and in some cases we need to make an expert Doctors opinion on the same to take it forward.
