Hi there, firstly to make it clear that the gender specific identity is your personal space and as per the Constitution of India no workspaces, be it Government Departments, can discriminate against you based on gender. In order to get your gender changed you need to apply to the national portal then submit a request to the sdm office. Post this there are some formalities which will be done by your lawyer (if you can on your own complete them, that's fine too). If you have any questions or need help feel free to contact me.

Yes. Under Indian law, your department cannot deny you employment benefits, continuation of service, or take adverse action merely because you choose to transition or identify as transgender. The Supreme Court in NALSA v. Union of India (2014) recognised the right of every person to self-identify their gender as male, female or transgender, and held that this is part of the fundamental rights under Articles 14, 15, 16, 19 and 21 of the Constitution. Discrimination in employment on the ground of gender identity is unconstitutional. Further, the Transgender Persons (Protection of Rights) Act, 2019 specifically prohibits discrimination in government and private employment, including recruitment, promotion, termination, and service conditions. Government offices are legally bound to treat you equally and allow you to continue in service after gender change. Practically, what usually happens is: • You can apply for change of name and gender in official records (Aadhaar, PAN, service records, etc.) after following the self-identification process under the 2019 Act • You may submit medical or self-declaration documents as required for record correction • Your service seniority, pension, and benefits remain intact No department has authority to force resignation, deny promotion, or harass you for transitioning. If any discrimination occurs, you can approach: • The District Magistrate (under the Transgender Act) • High Court (writ for violation of fundamental rights) • Human Rights Commission Your marital status or having a daughter does not affect your legal right to transition or your job. The government must allow you to transition Your job is legally protected Discrimination is illegal You can update service records lawfully If you proceed properly with documentation, there should be no lawful obstacle from the department.

The law is on your side. Under the Transgender Persons (Protection of Rights) Act, 2019, your department cannot terminate or discriminate against you for transitioning. However, you must formalize the change through the National Portal and the Official Gazette first. Once you have those legal documents, the department is duty-bound to update your service records.

You have the right to: Identify as transgender Apply for a Transgender Identity Certificate from the District Magistrate After medical transition (if you choose), apply for a revised gender certificate (male/female) This is your statutory legal right.
