Witnesses must be called upon by the police authorities at this stage as you mentioned the case was registered under 156(3) crpc. The report submitted by the police authorities to the magistrate can be cross-checked and the Witnesses should be cross-examined.

Sir It is important to note that if the Application under Sec. 156(3), Cr.P.C. has not been decided yet, you must make sure that effective arguments are made before the hon'ble court. In case, even after the arguments, the said Application isn't allowed and FIR is not directed to be lodged, an application under Sec. 200, Cr.P.C. should be filed by you to lead complainant evidence, where you will have the chance to prove your case on merits. This is not the stage where the witnesses will be called in court. For more insight, you may consult me in this regard!

you should give all these proof to LD. Metropolitan magistrate where 156(3) is pending if you have enough proof ATR does no do much as the decision would be taken by LD. MM after taking into consideration all the available evidence. It should be your advocate who has to do the things right
