exparte judgement due to my lawyer cheating

01-Sep-2023 (In Civil Law)
my dad had purchased a property in chennai with unregistered sale deed 1989. since it was a paramboke land only the power of attorney was registered.. he had to shift his residence to mumbai due to transfer and left the property on the hands of my maternal grandmother. My uncle (mom's bro) used the property too. After my dad came to chennai in the year 2010 he asked for the property my uncle denied leaving the property and filed a case saying that he is living in the property for so many years. Till 2010 all the major receipts (EB, property)tax is in my dad's name. Due to his influence he somehow got to my advocate and my case was judge exparte since my lawyer never communicated to me about the same. With the exparte judgement he changed everything to his name... We really dont know how to go again with this case... kindly help

Dear Client, Don’t worry.very simple file a appeal petition. In the meantime you collect all documents from registration departments and also get a information from .EB, village office ( RTI).if possible file a criminal complaint against him( not easy). That all based u will get a property... (long process).

You will have to file a petition to set aside ex parte decree and then you will have to contest the case. You may have to file a delay condonation petition for having not filed within limitation. If the case is brought back on record, the property will become a lis pendens property and so your purpose will be solved.
