Divorce procedure with mutual consent

25-Oct-2023 (In Civil Law)
Me & my spouse got married 5years back under hindu marriage act. It was a love marriage after 7 years of courtship. but within one year of our marriage there have been numerous instances of my spouse being engaged in extra marital affairs, getting proffessional escort services etc. and the situation is not getting better even after a lot of efforts. I want to file divorce because of this. what would be the procedure.?

If you want divorce by mutual consent, you must approach the court along with your spouse and file a petition. You will be awarded divorce after the 6 months separation period.
If you want to file a case for contested divorce, you have to file a petition on the ground of adultery. There is no necessity for the presence of your spouse at the time of filing the petition.
