Devottar Partial Property occupied by other how to restrain him

I am Sevayet & Owner of Partial Devottar property with existing temple. My father transferred, relinquished Sevayet right in favour of me and another blooded brother by regd deed out of 5 sons & 2 daughter. My partner unmarried brother expired. Now others and some miscreants collecting money in the name of temple & forcefully occupied land and handed over to others. What to do restrain and over come the situation.
Very complicated matter you shd file case in High Court for recovery of possission and also file case on tresspassing Act.

File a title suite in the lowest court having power to try the case for a declaration of title over the property ( appropriate prayers to be made here) and also simultaneously file an injunction application restraining the miscreant trespassing, unlawfully occupying and carrying out illegal activities out of the said land/lands

you have to seek relief from the proper court of law against the miscreants who intending to grab your property. Please note that any trust property could not be transferred without obtaining of a proper and appropriate court order. If any one doing so the same shall be his sole risk.

MY OPINION THAT i have follow your problem and i think that if you have got Sevayet right which you by legal way of Sebayetship ,you have legitimate right /rights still you have alive, if any third party entered then you have right to legal counter by multiple ways,and you can every right to established your legitimate stand as Sevayet.
