DEFAULT OF LEASE FEE PAYMENT FOR 5 MONTHS

I've given licensed premises situated at SECTOR II, SALT LAKE, KOL-700 091 on Leave and License @84,000 PM from Sept 18 to July 19. Lessee (private Ltd co in Kol. Lessee not paying lease fee for 5 months despite giving termination notice on 31-10-18 terminating lease wef 30th Nov 2018. Lessee refused to vacate the premises and continues to occupy the licensed premises unlawfully. Have decided to move district civil court for vacation of the premises by the party. Financial amount involved would be approx Rs.5.50 lacs including TDS non-compliance. Should the case be filed at Munsif Court at Bidhan Nagar or District Civil court, Barasat? advice is sought and also contact details of a good lawyer practicing in Munsif court and barasat court. if your lease deed is registered then file a suit of cancellation of lease deed before District Judge along with that file 144(2) under section Cr.PC then if necessary move high court don't go a recovery of possession suit it will be long term process

In my opinion at first serve a legal notice and if the matter is not solve then you can file eviction suit before the Barasat Court.


But without detail discussion and document review proper consult is not possible.
