Defamation Suit Along With Civil Property Suit

19-May-2025 (In Civil Law)
I am a guy and my fathers brother has filed some civil suits on me which I responded. But he is continuously giving false statements and filing law suits against me. So I am thinking to file a defamation suit on him for his false statements where I have all the proofs. Assuming my family annual income is 30 lakhs per annum. How much amount I can quote for the defamation suit.

Based on your situation, where your uncle is filing multiple false suits against you, you may consider filing a defamation suit if you have strong evidence proving the falsity of his statements. Given your family’s annual income of ₹30 lakhs, you can reasonably claim compensation between ₹10 lakhs to ₹1 crore, depending on the damage caused to your reputation. However, it is crucial to ensure that the defamation claim is backed by clear evidence and that the compensation amount is justified based on the harm suffered. Amount depends how the suits have affected your day to day to day life, your work life, your image in your neighbourhood and accordingly you can quote the amount.. does anyone in work space know about your cases .. is the defamation public in nature?

For a defamation claim to proceed, a critical element is proving that the imputation (allegation) was made with the necessary mens rea (intention) to harm the individual's reputation. Typically, courts are hesitant to admit defamation cases based solely on the pleadings. However, if your uncle's statements were made publicly and demonstrably caused you loss of reputation, a court may consider and admit the matter. To provide you with comprehensive guidance, please furnish detailed information and all relevant documentation.

Yes we can file a defamation suit against him but the quantification of the same depends on the loss incurred due to such false statements and the loss can be quantified basis on the income derived by you alone

Let me first tell you that defamation suit can't simpliciter be filed based on false accusations. Given the scenario in which you are there are better retaliatory options to consider. For instance filing property related suits ( after all it hurts if economics is involved). Other Civil remedies can be discussed too
