Dear sir,
I purchased a DDA Freehold property 80 gaj in Yamuna Vihar, Delhi -110053.
We are two partner in this property 50% shear each. In this case one partner sold out his 50% shear without inform to other .
Is there is any Law to stop the Registration of this property. Because I want also want to purchase.
Since it is a joint property, the property should not be sold without the permission of the other partner, especially when it is a dwelling property.
In case it is a dwelling property the registration can be stopped, since even if he sells his share he won’t be able to acquire possession of the same

The right of first refusal is a contractual right through which the owner of the property contracts that if and when he decides to sell the same, he will first offer it to the other contracting party ahead of any other purchaser. In your specific case did the two of you have any such clause in place in your partnership agreement? If not then no such right would exist considering it would operate as a clog on the right of the owner to alienate his property.
