Damage to property due to neighbour's negligence What can i do

Dear sir, I have my residence in a village. My neighbour has milking animals viz cow and Buffalo. He kept them at such a place intentionally that these animals interfere with my house wall. Over a period of time, they have damaged the wall to such an extent that it may fall anytime and may endanger someone's life. I told my neighbour many times regarding this issue but he did not pay any attention to it. What should I do ? Can I ask for its compensation ? Where should I approach i.e. court or police ? I need your advice.

You can intimate the situation to SDM of your area, he is the right person to intervene in to the matter. He can give conditional order for removal of such nuisances under Crpc. 133 up on taking some material evidences from your side. So it will advisable to you to go to SDM with pleading your case with supporting documents. You can take help of expert lawyer for drafting the application. Thanks o reaching us.

I understand the situation you are going through at the moment. First you can send him a legal notice showing your intention to sue him. And if he still continues with the same, you can file both FIR and civil suit for compensation of damages. Let me know if you need my further help.

You have two options to come over with this
1.you may file an application under section 133 CR.P.C before District Court where the property is situated and the learned court shall restrain the neighbour to make nuisance.
2.You may file a suit for damages against neighbour.
You make take any one or both actions against your neighbour.
