Whether property in question is joint family property? or self acquired property of your parents/still they are living/let me know -at the time of gift deed if it is self acquired property of your parents then the question of taking the signature of your brother does not arise, and it is exclusive property of yours if not at the time of gifting if property belongs to joint family then the signature of the your brother to establish that he is relinquishing his rights the signature is necessary. Let me know whether your father has shared his property among you and your brother, you have any document to establish.

What is the case number. Please give all the details of your case. Is there any agreement made between you. Is there a gift deed made between you and your parents? Need all the details submitted by them in the court so that you can file your vakalath and written statement.
