09-Oct-2023 (In Civil Law)
I am fighting a case aginst my brother for division of property built by my father. But i don't have the papers - he has them. Despite my mother swearing in affidavit of the same, the judge has dismissed the case. what should I do?

hello
the division of property has to be done among the legal heirs to the property. the papers cannot be cited as a ground for dismissing the petition. even if he has the papers, then too, you and your mother have a share unless your father has willed his property in his name, which is not the case I presume. challenge the dismissal.
