Cancellation Of Gift Deed of Ancestral Agricultural Land

18-Sep-2025 (In Civil Law)
My father has made a gift deed of undivided ancestral agricultural land in favour of my younger brother's son. I am an elder son and coparcener and made my own house in that land which is not converted into non agricultural land. Before this process of conversion started, the land was gifted. I filed a civil suit under the Hindu succession act but UPZA and revenue code section against me. What outcomes would come?

“Since the land is undivided ancestral agricultural property, your father could gift only his share, not the entire land. As a coparcener you have an equal right, and the gift deed can be challenged. The civil court under Hindu Succession Act can protect your share, and UPZA/Revenue Code objections do not extinguish your coparcenary rights. Most likely, the deed will be held invalid beyond your father’s share, and your portion remains secure.

Bina coparceners ki marzi ke ancestral land ka gift deed void ho sakta hai, court aapke hissa ya poore gift ko radd kar sakta hai. UP revenue law bhi aapke paksh me hai, outcome aapke favor me aane ki sambhavana hai.

on the above mentioned query the legal opinion is that why you filed case under Hindu succession act, who opine you? you have to to be file a case for cancellation of gift deed while the property is ancestral. the gift deed only executed when the executer owned the property on his own earning. so please file cancellation suit in the concerned civil court.
