No you can't get any Stay on this ground that your children are preparing for their secondary and sr sec examination and due to construction work they are not concentrating on their studies, as Your neighbor strarted construction on his own land, which does not comes under the defination of any nuisance,

yes, this is your right to enjoy a peaceful life and when it is question of career of students , studies administration will take care of this for this purpose you first approach to SDM of your area or Tehseeldar in case you are living in a city where commissioner of police is there then approach to deputy commissioner of police and give application for the same showing reasons if you find that nothing is happening then file a temporary injunction /stay order through your advocate.

yes, you can seek remedy in civil court,either filing a suit for temporary injunction or permanent injunction and also will get stay from District court too. u/s 37 of Specific relief Act, u can seek temporary injunction. order xxxix of cpc provided the procedure for that.
