25-Jul-2023 (In Civil Law)
sir a service law was contested in karnataka high court. the respondent did not produce documents relevant to the case and got judgement by surpassing material evidence.the petitioner appealed and won the case. the respondents petitioned supreme court and the petitioner won the case. supression of material evidence amounts to fraud.this judgement now became a precedent for many cases. can this judgement now be challenged after getting the relevant documents by RTI.

It is not understood why a respondent should produce documents. If a case is filed, it is for the petitioner to produce documents and evidence at his disposal to support his case. He is not supposed to depend upon the documents or evidence of opponent. When once the case is decided, the appellant is supposed to bring to the notice of the court any fraudulent practice of the respondent. The courts would give judgement based only on the materials, evidence, documents presented before it and not on any extraneous facts. If the Hon'ble Supreme Court has passed orders on the appeal arising out of Hon'ble Karnataka High Court's verdict, it is final. You have no forum to challenge the orders/verdict/judgement of Supreme Court of India.

Sir,
The judgment passed by Supreme Court is final.Regarding obtaining favourable order from Supreme Court by suppressing material facts does not arise because the Apex Court deals with the legal aspect of the case and not regarding the trial of the case. The parties are given opportunities before the trial court as well as before the appellate court, if they failed to bring the facts, the case will be decided on the basis of the material available on record.
Thanks and regards
