Can GPF details asked under RTI

18-Aug-2023 (In Civil Law)
Greetings to all. My father is a state Govt. employee & died in service on 2016. At Present, his brother (not a legal heir & separated from family since 2001) got my dad's following details through RTIn1)date of appointment, n2)GPF number, n3) his last drawn salary, n4)nominee details from his service registry,n5) Gratuity amountn6) Insurance claimed n7) Scheme of Pension & Pension amount & Pensioner details through RTI. Once the concerned office, received the RTI application, they provided all the details to him.My Questions: 1)how could the officials provide deceased one's personal info (GPF number, Nominee details) to a third party (other than the deceased's legal heirs) under RTI as it violates Section 8(1)(j) & Section 11(1) of RTI Act. Kindly provide me some legal advice & suggestions to do next. Thanks in advance.

Being the brother of your father he was given employment and emolument details of your father. If your father was alive he would have been informed about the right to information application from his brother and he could object to reveal the information. As your father is not alive the information sought by his brother has been provided to him.
