Builder cheating as pretend owner of government land

I had going to bought plot of 50 sq yard in Chattarpur South delhi, deel was finalized in 23.5 lakhs and made the agreement when paid 12 lake (5 lake in cheque &7 lake in cash) there after made part payment of 4.5 lakhs in cash for which builder gave me handwritten receipt on simple paper (without revenue stamp) but wrongly mention year 2018 instead of 2019. After all this I knew that the plot was on government land for which I have paid 16.5 lakhs to builder. Now builder refuse to return back my money. He said that you draw back with deal so as per agreement your money is forfeited, but how could I purchase government land(showing gram sabha kabristan)? What should I do? Is really my money forfeited by builder as per agreement clause while he is cheating with me?
