BOND PENALTY for discountinuation of course

02-Jul-2026 (In Civil Law)
I was doing md in Government Mohan Kumaramangalam medical College. I had to discontinue due to my health issues. The college is demanding 15 lakh rupees as discontinuation penalty. I have signed a bond for the same during admission. I left due to a medical unavoidable reason. Is there any way i can get a waiver or a reduction in amount to 5 lakh

If you discontinued the MD course due to genuine medical reasons, you may seek waiver or reduction of the bond amount by submitting a detailed representation to the Dean/Director of Medical Education with all supporting medical records. If the request is rejected, you may approach the High Court under Article 226 of the Constitution challenging the demand as arbitrary or disproportionate, particularly if your illness made continuation impossible. Whether the amount can be reduced to ₹5 lakh depends on the bond terms, Government Orders and the facts of your case. Please preserve all medical evidence and the bond documents before taking further legal steps

Since you discontinued the MD course due to genuine medical reasons, you may submit a detailed representation to the Dean, the Director of Medical Education, and the Health Department seeking waiver or reduction of the bond amount by enclosing all relevant medical records, discharge summaries, and medical certificates. Although you have executed the bond, the authorities have the discretion to consider compassionate circumstances. If your request is rejected, you may challenge the decision before the Madras High Court under Article 226, particularly if the penalty is arbitrary or disproportionate in the facts of your case. Courts have, in appropriate cases, granted relief where discontinuation was due to unavoidable medical reasons. You may also seek permission to pay a reduced amount or in instalments as an alternative relief.

Since you discontinued your MD course due to a genuine and medically unavoidable health condition, there may be scope to seek waiver, reduction, or reconsideration of the ₹15 lakh discontinuation amount. The first step is to examine the exact bond executed at the time of admission, the applicable PG prospectus/Government Orders for your admission year, and your medical records. Tamil Nadu Government medical PG bond conditions have been the subject of several proceedings before the Madras High Court, and the enforceability and applicable amount can depend on the batch and the precise terms of the bond. You should submit a detailed representation to the Dean/Directorate of Medical Education seeking waiver or substantial reduction, enclosing medical certificates, treatment records, discharge summaries and other evidence showing that continuation of the course was medically impossible. If the authorities reject the request or insist on the full amount without properly considering the medical circumstances, a writ petition before the Madras High Court can be considered, seeking appropriate relief based on the facts and applicable Government Orders. However, a reduction specifically to ₹5 lakh cannot be guaranteed and will depend on the bond, applicable rules, medical evidence and judicial discretion.
