Questions Answered by Advocate Sunil Raju S

Q: A neighbour in our flat (total 6 flats ) is causing troubles to me

A neighbour who is one among our ground floor apartment is giving troubles over the last 3 years in someway . I'm a single living woman,my neighbour or his wife talks about me to vendors or others in irrespective manner or stalking on allows a stray dog (which comes in only if a gate is open as it can't jump due to its leg injury) purposely towards my bike parking which creates a rift between my pet & stray , despite giving notice of same. Can I give legal notice or police complaint with proof

Advocate Sunil Raju S answered
Yes, you have legal remedies, provided you have sufficient evidence. If your neighbours are repeatedly making false and defamatory statements about you to vendors, other residents, or visitors with the intention of damaging your reputation, you may initiate appropriate legal proceedings for defamation. If they are continuously monitoring, following, intimidating, or harassing you, you may also lodge a police complaint for criminal intimidation, harassment, or stalking, depending on the facts and available evidence.Regarding the stray dog issue, if it is being deliberately allowed into the apartment premises to create nuisance, provoke your pet, or interfere with your peaceful enjoyment of the common areas despite repeated objections, you should first submit a written complaint to the Apartment Owners' Association/Society seeking immediate intervention. If no action is taken, you may approach the local police or the competent civic authorities with supporting evidence.Preserve all available evidence, including CCTV footage, photographs, videos, audio recordings (where legally permissible), WhatsApp messages, witness statements from residents or vendors, and copies of any prior written complaints. Before initiating litigation, it is advisable to issue a legal notice demanding that they cease their defamatory and harassing conduct. If they continue despite the notice, you may proceed with appropriate civil and criminal remedies in accordance with law.

Q: BOND PENALTY for discountinuation of course

I was doing md in Government Mohan Kumaramangalam medical College. I had to discontinue due to my health issues. The college is demanding 15 lakh rupees as discontinuation penalty. I have signed a bond for the same during admission. I left due to a medical unavoidable reason. Is there any way i can get a waiver or a reduction in amount to 5 lakh

Advocate Sunil Raju S answered
Since you discontinued the MD course due to genuine medical reasons, you may submit a detailed representation to the Dean, the Director of Medical Education, and the Health Department seeking waiver or reduction of the bond amount by enclosing all relevant medical records, discharge summaries, and medical certificates. Although you have executed the bond, the authorities have the discretion to consider compassionate circumstances. If your request is rejected, you may challenge the decision before the Madras High Court under Article 226, particularly if the penalty is arbitrary or disproportionate in the facts of your case. Courts have, in appropriate cases, granted relief where discontinuation was due to unavoidable medical reasons. You may also seek permission to pay a reduced amount or in instalments as an alternative relief.

Q: My aadhar name is completely diffrent

My aadhar name is completely diffrent and i have voter id and ration card in my correct name i need to correct my name as per voter id and ration card

Advocate Sunil Raju S answered
If your Aadhaar contains an incorrect name and your Voter ID and Ration Card reflect your correct name, you can apply for correction of your name in Aadhaar through the nearest Aadhaar Seva Kendra or authorised Aadhaar Update Centre. Submit a request for demographic update along with valid Proof of Identity/Proof of Relationship documents supporting your correct name. If the discrepancy is substantial, UIDAI may require additional supporting documents or a Gazette Notification. If your request is rejected despite producing valid documents, you may file a grievance with UIDAI and, if necessary, seek appropriate legal remedies. Ensure that all your identity documents carry the same name to avoid future legal and administrative issues.

Q: e-Filing of Writ Petition regarding

Can a Writ Petition be filed to Madras High Court (by a party-in-person) via e-filing website (https://filing.ecourts.gov.in), or should it be done only physically offline?

Advocate Sunil Raju S answered
Yes, a writ petition can be filed before the Madras High Court through the e-filing system, subject to the High Court's prevailing e-filing rules and eligibility for party-in-person filings. If you are appearing as a party-in-person, you may register on the e-filing portal, upload the petition and supporting documents, and comply with the prescribed format, court fee, affidavit, and other procedural requirements. However, certain categories of cases or defects may require physical verification or appearance before the Party-in-Person Cell/Registry.
