Big earthen pots kept in common passage area

10-Apr-2023 (In Civil Law)
My neighbour has kept big earthen pots in common stairs passage area. I had complained the same to MCD as well as Police. But despite several followups no action is taken. My neighbour is very influential and has some big contacts in MCD and police. Rather he threatened me to not touch his plants as it is his personal property and willl initiate legal action against me if i touch his plants and earthen pots. Kindly advice me if i can take some legal course in this regard and what are the chances of getting relief.

Sir You should file a civil suit for permanent and mandatory injunction along with stay order application in the civil district court of your jurisdiction and make MCD a party to that suit. Before that a legal notice should be sent to the opposite party. I have successfully secured favourable orders from court in ongoing cases similar to yours. If you need an efficacious remedy you may consult me in this regard. good luck!

yes you can definitely take the legal course of it is the common stairs and the common passage area then no one can create hindrance in that and no one can use the same for the personal usage....as far as mcd is concerned..you can file a civil suit against the neighbour and can also file a case against mcd stating they are not listening to you.

Hi, You can file a suit for injunction and also a suit for damages. Also since your neighbour is threatening you, you can file a written police complaint against him and can make the officials he claims to know as party. Also you can file a police report regarding nuisance that is being caused by the pots. By going to court you can easily get the pots Removed and nuisance avoided. For further queries please connect
