Agricultural land encroachment by neighboring land owner

Our Agriculture land 3 gunta has been encroached by the neighboring owner. We did a government land survey in 2012 & came to know that encroachment. We have land survey report mentioning 3 gunta encroachment. During the survy time, the encroached land owner agree to leave 3 gunta after prop cultivation. Till now, he has not left 3 gunta even after repetitive request. Now, he has started developing site layout in his land & along with our encroachment land. Is the survy report valid even after 8 years & bring stay order or how I can proceed with this dispute

As you informed that you have knowledge of encrochment in year 2012 and waites till date is mistake.
now you can file a suit for declaration claiming that the the encorchmwnt is illegal.
yes you can file after 8 yeras also but you need to show the encrochment came to know your knowledge recently.
as you told he started construction. better you file a civil suit immediatly and seek injunction against that person not to construct any thing on encroched area.
