2BirthCertificates issued by same Municipality for me. How to handle ?
19-Feb-2026 (In Civil Law)
Cert1 - within 21 days of birth & Cert2 within 3 yrs of birth. Both have 2 different firstnames. Same Middle, last & parent names in both. Also both have 2 different birth year (exactly 1yr gap). Cert1: 20/7/1986 & Cert2: 20/7/1985. All my education records(10th/higher), Passport, Government records (Voting & Pancard) follow a consistent firstname from cert2 & consistent date of birth from cert1. Now I really need to use BC (earlier it was not used since I was born before 1989)
why was there 2 birth certificates issued?
you will have to file for cancellation of the wrong birth certificates and correction in the birth certificate which has wrong birth date.
you can approach the Municipal office or court, depending on which State you are in

Since you have two birth certificates with different first names and different years of birth, this is a serious record discrepancy and should be regularised before you use the birth certificate for any official purpose.
From what you have stated:
• Name in education, passport, PAN, voter ID follows the first name from Cert2.
• Date of birth in all records follows Cert1 (20/07/1986).
• The two certificates show a one-year difference (1985 and 1986).
In such cases, the safest legal course is not to “choose” one certificate informally, but to formally correct the birth record through the appropriate authority.
The proper steps generally are:
1. Apply before the Registrar of Births & Deaths for correction/cancellation of the incorrect entry under the Registration of Births and Deaths Act.
2. File an affidavit explaining the clerical error and stating the correct name and date of birth.
3. If the Registrar refuses correction (especially due to time lapse), you may have to approach the competent Civil Court for a declaratory decree declaring your correct name and date of birth.
4. After decree, the municipal authority can be directed to rectify records.
Since your passport and education records are already consistent, the objective should be to bring the birth certificate in line with the majority official records to avoid future complications.
This is not advisable to handle casually, as mismatch in name and date of birth can create issues in employment, property transactions, or government procedures. Legal intervention at this stage is important to ensure your records are regularised properly and permanently.
You should file a Declaratory Suit in Civil Court to establish your correct identity. Since your educational and government IDs (Passport/PAN) match the name from Cert2 and the date from Cert1, the court can issue a decree to rectify the mismatch. This legal declaration will override the conflicting birth certificates for all official purposes.
