How can I file for custody of my son

I m divorce my son custody is with his father ,my son stay in karnataka with his grandmother his father work in pune .I stay in Mumbai.I don't have my family support so I did not got custody I decided to get marry so that I'll get support for custody is this will work.or I should fight single .my ex husband still abuse me .how I can take my son custody my son want to stay with me .
Dear client I can file custody petition under Hindu minority and guardianship act. U can show the court that son is not actually in custody father. You have not provided the age of the child, do i assume that he is above 5.
