How can I claim maintenance and child custody from husband

married 7 yrs before both doctors but he don't want to continue relations so stayin separately since 3yrs. by counselling v came together for 6mths but didn't work so again I moved torentedflatwithdaughter. legal issues: he doesn't pay me any expenses of my daughter, flat as monthly rent is 22000 and it will hike per yr by 10 %. Now he needs divorce from me as he wants child's custody. Legal solution: can he demand for child's custody after divorce or before it ,as child has stayed with me since 5yrs. is it compulsory for me to sign divorce papers as he ready to pay only 15000/mth

Dear client of is not compulsory for I do sign divorce paper. If he file divorce then I can claim good amount as one time alimony. As child is residing with IOS it is hard to get custody to yr husbnad. I can claim maintenance for child by filing case under sec 125 in court. For any legal help call me

There is no compulsion for anything in matrimonial cases.
There should be free consent of both the parties.
He can claim custody of the child, but court will see only welfare of the child irrespective of your rights.
You can claim maintenance upto what standard of living he is enjoying.

Doctor are really talented person and meritorious in all respect.
You & your daughter are not ELIGIBLE to get maintenance from your husband since as doctor you are capable to earn money to satisfy you need like food, cloth, shelter etc. i.e. basic need of every human being.
No need to stay in luxurious apartment where rent is 22k with 10% hike. apartment is also available in 5k PUNE costly city also have such kind of accommodation.
Regarding legal custody by fact it is with you.
If both are mutually agreed not to leave together then take MUTUAL CONSENT DIVORCE.
