Child Custody After a Mutual Divorce

I have been divorced on Oct 21st 2019 and staying in california (Employment Visa) and currently my son - 6 years old whos is also a US citizen is residing with her grand mother (in Ujjain) while his mother is working in bangalore , as per initial agreement We had decided that child will stay with her (Mother) and I will have anytime access to to my son. We do not have any Custody Agreement in Place except for a clause in Divorce Document which reads that "child will stay with her (Mother) and I will have anytime access to to my son" . Need to discuss child custody Joint

For the custody of child, you have to take legal action where the child resides. As you son is only 6 years old, it's most likely that the custody will go to mother, however the welfare of the child shall be the paramount consideration.
