Can a mother who has no house of her own claim custody of her child against a father who has a house. If the mother goes and stays in another man house not being divorced can she then claim custody.
Generally custody of a child goes to the mother irrespective of whether she owns a house or not infact she even has right to claim shelter from husband but u have mentioned that she is residing with someother man without getting divorced the same can be ground to deny her custody however any conclusive comments can only be madr after going through your case details in depth.

If she is living with another man in adultery then it is difficult for her to get custody.

dear client though mother is homeless still she can claim custody of child. but if she stayed with other man without divorce then she will not get custody. because residing with other man without divorce amount to adultery. while decide custody petition court see the atmosphere of house where child will be raised. so if mother will live in adultery then court will not give the custody of child to her. for any legal help call me
