what to do if cheque bounce case file is missing in court

09-Apr-2023 (In Cheque Bounce Law)
Hi Post cheque bounce, my lawyer filed for cheque bounce case in city court approx 1.5 yrs ago. Post that there were retirement of judges, new appointment, court got shifted to new premises etc. Now it seems my lawyer says, they are not able to trace the file in court. I have been following up, but i seems they are still searching !! Can someone advise on my questions below 1. What are the other options available ? 2. I heard of mandamus/writ petition, but has that to be filed only in high courts? Cant it be filed in district courts ?

No the said writ of mandamus can only be file in the High Court of a State. Also, for obtaining the case file, you can apply for certified copy of the case file in the court/ahlmad's room. Also, it may take time of few weeks to get the same.
