Under which sections can I file a case for cheque bounce

15-Apr-2023 (In Cheque Bounce Law)

After cancelling the flat booking, got the cheque and now when i deposited the cheque, it got bounce. So after sending legal notice if they didn't pay then, under which sections I can file the case? So that I can get my money as soon as possible with interest and able to get my all expense back. Can I know the difference between Section 138 ad 141 ?

S.138 of NI act deals with dishonour of cheques for insufficiency of funds in the bank a/c.
S.141 deals with offences by company, when the Director / officer of company is liable for the offence
of dishonour of cheque. If u have already received the memo from the bank stating the reasons for return of the cheque u can go an advocate and he/she can issue a legal notice on u r behalf.
