Took cheque from mother but didn't pay the third party.

Dear Sir, my two brother taken cheque of my mother. to get money from financer. after 6-8 yrs they didnt pay and get cheque back. Mean time family problem all dispersed. Now they put legal case on mother. from 6 months attending the court. still brother not responding for the case. my question is * how to punish this dishonest - irresponsible- care less brother? *Can she withold the property or sell the property to clear the case? *the amount claim for 25,000 IRS is 1 lakh. *the amount claim for 75,000 IRS is 6 lakhs, even arrest warrnet has been issued? suggest me
