salary Cheque bounced, PF not deposited

Dear Sir, I was working with the company which is in Taloja MIDC . Two months before I left the company & he has given the PDC of my full and final settlement. At the due date of cheque he requested not to deposit the cheque as there is no cash in the account. Again after 10 days he told me to deposit the cheque and cheque was bounce. I am trying to contact him but not responding. I informed him i am going to take legal action then within a week he deposited 50 % amount but again not responding.

Well, I think, a Legal Notice will suffice in your case and after sending Legal Notice, he will deposit the balance amount of your dues. If after sending Legal Notice also, your Ex-Employer does not release your outstanding dues, you can file a case against him of Cheque Bouncing, you can still file depending upon certain factors!

You need not wait for the other side reply for depositing the cheque in the bank. If the cheque is signed, then you can deposit the same in the bank. If it gets bounced, then you will have to send demand notice to the company within 30 days in order to initiate action under negotiable instruments act, 1881. in case you require any further legal assistance you may contact me.

You can file a case under Sec 138 of NI Act for cheque bounce. Send a legal notice within 30 days of bounce memo. If no payment in 15 days, file a criminal complaint. Seek a lawyer’s help and send the notice immediately.

You have no option but to cheque bounce case against the concerned person. If you don't shoot legal notice within month of the cheque bounced your cheque will be time barred and you will not be able to file any cheque bounce matter thereafter. So it would be wise to file it within the limitation.
