Person gave me a big cheque and cheated me. What can I do?

ONE PERSON CHEATED ME AND GAVE CH FR RS 65 LACS i have evidence he has taken 3 lacs and in his wife account i deposited 20 lacs rest withdrawl evidence is with me i filed case us 138 whats my position
Under section 138 of Negotiable Instruments Act you have to give a legal notice to defaulter within 15 days of dishonour of cheque to make payment within 15 days from receipt of legal notice . Still if default continues you can file criminal cae against defaulter in the court of law.
