Hello,

Whatever might be the reason for dishonor of a cheque by a bank whether it might be "Stop Payment" instruction by the drawer of the cheque or any other reason, offence under Section 138 NI Act is made out and the drawee can initiate proceedings against the drawer of the cheque after duly serving the drawer a demand notice for payment of the cheque amount and upon failure of the drawer to pay the cheque amount within the mandatory period.
