25-Jul-2023 (In Cheque Bounce Law)
Despite of continuous requests, my friends is not returning my money and is making excuses. I am tired of him not taking me seriously and need to take action. I need guidance as i am not in india. I would like to proceed with legal actions from canada.
You have not mentioned the nature of transaction, type of income, source of income, amount lended to the friend or agreement with the friend. Depending upon what all papers do you have and whom do you empower in India for the legal actions to act on your behalf is also not certain. In the absence of such vital details, any professional would feel hesitation in recommending any legal remedy or options. Why don't you take s few days to sort and arrange all the paperwork and then connect with me professionally so that I can see what needs to be done!
I can guide you professionally on chargeable basis, once my fees are paid. Feel free to connect.

you can not request for an unlimited period. finance can not come in between friendship.
when you call a friend, do not talk about finance; when you talk about finance, do not talk as a friend.
initiate written communication to recover funds. that will help. if you have crossed more than one year against a committed period, it is more important to do so.

Yes, you can take a couple of measures to recover the said due. However, conclusive information is required to guide you with the best possible legal recourse to get the said due from your friend, especially when you are abroad.

First of all you should give power of attorney (POA) to your relative/friend who is in India to sue your friend. Then you can file 138 NI case if your friend has given you any check against the money given and if your friend has not given any check then you can file summary claim through your POA.
